§ 1 - Preliminary Provisions
- The online store Lash Crash, available at www.lashcrash.com, is operated by Webgie sp. z o.o., entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register, NIP 6793366778, REGON 544819753, KRS 0001241904.
- These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Store and define the rules for using the Online Store as well as the terms and procedures for concluding Distance Sales Agreements with Customers through the Store.
- The governing law of the contract is Polish law. The Consumer is also entitled to rights and claims against the Seller provided for by the law of their country of residence.
§ 2 - Definitions
- Consumer – a natural person entering into a contract with the Seller via the Store, where the subject of the contract is not directly related to their business or professional activity.
- Seller – Webgie sp. z o.o., entered in the Register of Entrepreneurs of the National Court Register, maintained by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register, NIP 6793366778, REGON 544819753, KRS 0001241904.
- Customer – any entity making purchases through the Store.
- Entrepreneur – a natural person, legal person, or organizational unit that is not a legal person but has legal capacity granted by law, conducting business on their own behalf and using the Store.
- Store – the online store operated by the Seller at www.lashcrash.com.
- Distance Contract – a contract concluded with the Customer as part of an organized system for concluding contracts at a distance (within the Store), without the simultaneous physical presence of the parties, using one or more means of remote communication until the conclusion of the contract.
- Regulations – these Terms and Conditions of the Store.
- Order – the Customer’s declaration of intent submitted via the Order Form, directly aiming to conclude a Product Sales Agreement with the Seller.
- Account – the Customer’s account in the Store where their data and information about Orders are stored.
- Order Form – an interactive form available in the Store that enables placing an Order, particularly by adding Products to the Cart and defining the terms of the Sales Agreement, including delivery and payment methods.
- Cart – a part of the Store’s software where selected Products are visible, with the ability to determine and modify Order details, especially the quantity of Products.
- Product – a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.
- Sales Agreement – a sales agreement for a Product concluded or being concluded between the Customer and the Seller through the Online Store. Depending on the nature of the Product, this also includes service contracts and contracts for specific work.
§ 3 - Contact with the Store

- The Customer may contact the Seller via email, live chat, or contact form.
§ 4 - Technical Requirements
To use the Store, including browsing its assortment and placing Orders, the following are required:
- A device with Internet access and a web browser,
- An active email account,
- Enabled cookies.
§ 5 - General Information
- The Seller, to the fullest extent permitted by law, shall not be liable for interruptions in the operation of the Store caused by force majeure, unlawful actions of third parties, or incompatibility of the Store with the Customer’s technical infrastructure.
- Browsing the Store’s assortment does not require an Account. Placing an Order requires providing necessary personal and address details enabling the fulfillment of the Order. The Customer and their Account are identified by their email address.
- Prices displayed in the Store are gross prices (including VAT). The price and currency depend on the destination country. The Customer will always be informed of the final amount and currency during checkout.
- The final total price includes the Product price and delivery costs (including shipping, delivery, and postal services), which are shown to the Customer during the ordering process and at the time of confirming the intent to conclude the Sales Agreement.
- For subscription or ongoing services, the total price includes all payments for the billing period.
- If the nature of the Product prevents prior determination of the final price, the Store will specify how the price is calculated and any additional fees in the Product description.
- By placing an order, the Customer requests an invoice instead of a receipt and agrees to receive the invoice electronically at the email address provided in the Order Form.
§ 6 - Account in the Store
- To log in, the Customer enters their email address. A login code is then sent to that address to be entered in the next step.
- No prior registration is required. Data is stored based on the email entered in the Order Form.
- Using an Account is free of charge.
- The Customer may delete their Account data at any time, free of charge, by sending a request to the Seller via email specified in § 3.
§ 7 - Order Placement Rules
To place an Order, the Customer must:
- Select the Product and click “Add to Cart” or “Buy Now”,
- Complete the Order Form with recipient details, delivery address, shipping method, and payment option, and provide invoice details if different from the shipping details,
- Click “Order and Pay” and, depending on the payment method, complete the payment as required by § 8 point 3.
§ 8 - Delivery and Payment Methods
- Available delivery methods: courier delivery, parcel locker, or courier cash on delivery.
- Available payment methods:
- Cash on delivery,
- Electronic payments,
- Bank transfer,
- Credit/debit card payment.

§ 9 - Execution of the Sales Agreement
- The Sales Agreement between the Customer and Seller is concluded after placing an Order via the Order Form in accordance with § 7 of these Terms.
- Upon receiving the Order, the Seller immediately confirms receipt and accepts it for processing via an email sent to the Customer. At that moment, the Sales Agreement is concluded.
- Depending on the payment method:
- For electronic or card payments – payment must be made immediately upon concluding the Agreement.
- For cash-on-delivery – payment is made upon receipt.
- Delivery time shall not exceed 7 business days unless stated otherwise.
- If the Order includes Products with different delivery times:
- The delivery time equals the longest stated time,
- The Customer may request partial deliveries or a single combined delivery.
- The delivery time starts:
- For electronic/card payments – when the Seller’s account is credited,
- For cash-on-delivery – on the date the Agreement is concluded.
- Delivery is available to countries listed in the Order Form.
- Delivery costs are borne by the Customer unless otherwise stated. All costs are displayed on the Store’s website and during checkout.
§ 10 - Right of Withdrawal
- The Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
- The period begins upon delivery of the Product to the Consumer or their designated recipient.
- For multiple-item Orders, the period starts upon delivery of the last item.
- The Consumer may withdraw by submitting a withdrawal notice to the Seller via email or through the website.
- If submitted electronically, the Seller will confirm receipt of the notice by email.
- Effects of withdrawal:
- The contract is considered void.
- The Seller refunds all payments within 14 days, including delivery costs (except extra costs for non-standard shipping choices).
- The refund is made via bank transfer to the Customer’s account.
- The Seller may withhold the refund until the Product is returned and verified to be intact.
- The Consumer must return the Product within 14 days of withdrawal.
- The Consumer bears the cost of return shipping.
- The right of withdrawal does not apply to contracts for:
- Customized or personalized goods,
- Sealed goods that cannot be returned for health or hygiene reasons once opened,
- Perishable goods,
- Services fully performed with prior consent,
- Goods or services with prices tied to market fluctuations,
- Goods inseparably mixed with others after delivery,
- Alcoholic beverages with delivery after 30 days,
- Unsealed audio/video recordings or software,
- Newspapers, magazines (except subscriptions),
- Digital content not supplied on a tangible medium if performance began with the Consumer’s consent.

§ 11 - Complaints and Warranty
- All Products are new.
- If a defect occurs, the Customer may file a complaint under the Civil Code warranty provisions. For Entrepreneurs, warranty liability is excluded.
- Complaints should be sent via email to the address provided in these Terms.
- The Seller will respond within 14 days; lack of response means the complaint is accepted.
- Returned goods must be sent to the address provided by the Seller.
- Lash Crash provides a warranty for:
- 12 months for individual customers,
- 6 months for business clients.
- The warranty does not limit the Consumer’s statutory rights.

§ 12 - Out-of-Court Complaint and Redress Procedures
- Detailed information about out-of-court complaint handling and redress procedures is available from local consumer ombudsmen, consumer organizations, and the Office of Competition and Consumer Protection (UOKiK) websites: http://www.uokik.gov.pl.
- Consumers may:
- Refer the dispute to a permanent consumer arbitration court,
- Request mediation via the regional Trade Inspection authority,
- Seek free assistance from a consumer ombudsman or consumer organization (e.g. Polish Consumer Federation).
§ 13 - Personal Data
- The data controller is the Seller.
- Data is collected to perform the Sales Agreement and, with consent, for marketing purposes.
- Recipients of data may include:
- Courier companies,
- Payment service providers.
- The Customer has the right to access and correct their data.
- Providing data is voluntary but required to conclude a Sales Agreement.

§ 14 - Gift Cards
- Customers may purchase digital gift cards in the Store.
- The value of the card is chosen on the product page.
- The code is sent to the email address provided in the Order Form.
- To redeem, enter the code at checkout.
- Funds can be used for any products in the Store.
- Anyone with the code can use the gift card.
- The code can be used multiple times until funds are exhausted.
- Orders can be partially paid with a gift card; the remainder can be paid by another method.
- Gift cards are valid for 1 year from the email delivery date.
§ 15 - Final Provisions
- The governing law for contracts concluded through the Store is Polish law.
- The Seller reserves the right to amend the Terms for valid reasons (e.g. legal or payment method changes). Customers will be notified at least 7 days in advance.
- In matters not regulated herein, the provisions of Polish law apply, in particular: the Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act, and the Data Protection Act.
